Filing 8 ORDER: In light of the recent reassignment #6 , this Court vacates and strikes order #4 . Plaintiff's application for leave to proceed without prepayment of fees #3 is granted. The trust fund officer at Plaintiff's place of incarceration is authorized to deduct $12.81 from Plaintiff's account as the initial partial payment of the filing fee and to continue making deductions in accordance with this order as set forth below (100% of Plaintiff's income, when it meets statutory minimums, must be devoted toward his filing fees). Summonses, however, shall not issue. Plaintiff's complaint #5 is dismissed without prejudice for misjoinder. Plaintiff is granted until March 3, 2023, to submit: (1) an amended complaint on the Court's required form, as detailed in this order and (2) a completed USM-285 (Marshals service) form for each Defendant named in the amended complaint. Failure to do so by that date will result in dismissal of this case. The Clerk of Court is directed to: (1) send a copy of this order to the facility having custody of Plaintiff (electronically if possible) and to the Court's Fiscal Department; and (2) send a copy of this order to Plaintiff, along with a blank amended civil rights complaint form, a blank USM-285 form, and instructions. Plaintiff also must promptly submit a change-of-address notification if he is transferred to another facility or released. If Plaintiff fails to keep the Court informed of his address, this action will be subject to dismissal for failure to comply with a Court order and for failure to prosecute. Filing 4 ORDER: Plaintiff Paul Olsson, pro se, seeks permission to proceed in forma pauperis ("IFP") in this civil rights lawsuit against various employees of the mental health center to which he has been committed, in which he asserts due process claims under 42 U.S.C. 1983. Because plaintiff lacks any substantial financial assets, his IFP application #3 is granted. Further, his complaint passes this Court's initial screening, see 28 U.S.C. 1915(e)(2)(B)(ii), because, under the lenient pleading standards for pro se litigants, it states at least an arguable claim for relief. The Court instructs the Clerk to file plaintiff's complaint, issue summons for service of the complaint on defendants, and send plaintiff eleven copies of the USM-285 service form along with a copy of this order. The Court appoints the United States Marshals Service to effect service. By February 1, 2023, plaintiff must complete and submit a copy of the USM-285 form for each defendant against whom he wishes to proceed; the Marshal will not attempt service on any defendant for whom a completed USM-285 form has not been received. The Marshal is authorized to mail a request for waiver of service to the defendants in the manner prescribed by Fed. R. Civ. P. 4(d)(2) before attempting personal service.
