Filing 5 ORDER signed by the Honorable Edmond E. Chang. For the reasons stated in the Order, the Plaintiff's application to proceed in forma pauperis #3 is granted. The Court orders the trust-fund officer at Plaintiff's place of incarceration to immediately deduct $16.69 from his account for payment to the Clerk of Court as an initial partial payment of the filing fee and to continue making monthly deductions in accordance with this order. The Court directs the Clerk of Court to (1) send a copy of this order to the trust fund officer at Pinckneyville Correctional Center and to the Court's Fiscal Department; (2) file Plaintiff's complaint #1 ; (3) dismiss IDOC and Nurse Woke as a Defendant on the docket; (4) issue summonses for service of the complaint on the remaining Defendants; and (5) send Plaintiff four blank USM-285 (Marshals Service) forms, filing instructions, and a copy of this order. The Plaintiff must complete and return a USM-285 form for service on each remaining Defendant by 05/01/2023. Failure to return the USM-285 may result in dismissal of the unserved Defendant, as well as dismissal of this case in its entirety. Plaintiff also must promptly submit a change-of-address notification if he is transferred to another facility or released. If Plaintiff fails to keep the Court informed of his address, this action will be subject to dismissal for failure to comply with a Court order and for failure to prosecute. The Court appoints the U.S. Marshal to serve Defendants. The Plaintiff's motion for attorney representation #4 is denied without prejudice. To track the case only (no appearance is required, the case will not be called), a tracking status hearing is set for 05/12/2023 at 8:30 a.m. Mailed notice (cn). |
