Filing 7 ORDER: The Court grants Plaintiff's application for leave to proceed in forma pauperis #3 and orders the trust fund officer at Plaintiff's place of confinement to immediately deduct $36.73 from Plaintiff's account for payment to the Clerk as an initial partial payment of the filing fee and to continue making monthly deductions as discussed in the Statement section below. Payment of the filing fee for this case is in addition to any filing fees Plaintiff owes for any other federal cases and appeals. Plaintiff's complaint may proceed on an excessive force claim against Defendants Gruber, Conroy, Soustek, Shaugnessy, and Bledsoe. All other claims and defendants are dismissed. The Court directs the Clerk of Court to: (1) file Plaintiff's complaint #1 ; (2) issue summonses for service of the complaint on Defendants Gruber, Conroy, Soustek, Shaugnessy, and Bledsoe by the U.S. Marshal; (3) terminate all remaining defendants; (4) send a copy of this order (electronically, if possible) to the trust fund officer at the facility having custody of Plaintiff and to this court's fiscal department; and (5) send Plaintiff a copy of this order along with five blank USM-285 (Marshal service) forms and filing instructions. Plaintiff must complete and return USM-285 forms for service on Defendants Gruber, Conroy, Soustek, Shaugnessy, and Bledsoe. Failure to return completed forms by September 1, 2023, may result in dismissal of any unserved Defendants as well as dismissal of this lawsuit in its entirety. Plaintiff also must promptly update his address if it changes while this case is open. If he does not keep the Court informed of his address, this lawsuit will be subject to dismissal with no further notice. The Court appoints the U.S. Marshal to serve Defendants.
