Filing 9 ENTERED JUDGMENT on 3/28/2024. Mailed notice (axc). |
Filing 8 ORDER: By Order dated February 29, 2024, the Court denied Plaintiff's application for leave to proceed in forma pauperis without prejudice and ordered Plaintiff to either submit a properly completed application or pay the Court's $405.00 filing fee #7 . Plaintiff was also instructed to show cause why the case should not be dismissed for inaccurate representations concerning her finances. [Id.] At that time, the Court warned Plaintiff that failure to comply by March 21, 2024, would result in summary dismissal of this case. [Id.] To date, Plaintiff has not submitted a renewed application for leave to proceed in forma pauperis, paid the Court's filing fee, or responded to the show cause order. Accordingly, this case is dismissed without prejudice for Plaintiff's failure to comply with the Court's order. See Dietz v. Bouldin, 579 U.S. 40, 47 (2016) (collecting cases holding that "district courts have the inherent authority to manage their dockets and courtrooms with a view toward the efficient and expedient resolution of cases," including the "inherent power to dismiss case sua sponte for failure to prosecute"); see also Anderson v. Williamson, 748 F. App'x. 710, 711 (7th Cir. 2019) (dismissal without prejudice is appropriate disposition where plaintiff fails to satisfy the filing-fee requirements); Lankowsky v. City of Chicago, 2015 WL 4868619, at *2 (N.D. Ill. Aug. 13, 2015) (citing Easley v. Kirmsee, 382 F.3d 693, 698 (7th Cir. 2004)). The Court directs the Clerk of Court to terminate all pending motions #4 as moot. Case closed. Signed by the Honorable Franklin U. Valderrama on 3/28/2024. Mailed notice (axc). |
MAILED copy of Order #8 and Judgment in a Civil Case #9 to Plaintiff Stefannie Dyson. (axc). |
Filing 7 ORDER: Plaintiff filed this pro se civil action under 42 U.S.C. 1983. Plaintiff's application for leave to proceed in forma pauperis #3 is denied without prejudice because it is incomplete. By March 21, 2024, Plaintiff must: (1) submit a renewed IFP application (or pay the full $405 filing fee); and (2) show cause why this case should not be dismissed for inaccurate representations concerning her finances. If Plaintiff fails to comply with this Order by the aforementioned date, the Court will summarily dismiss this case. Plaintiff is advised that she has a continuing obligation to keep the Court apprised of her current address, and failure to do so will result in dismissal of this action for failure to comply with a court order and for want of prosecution. The Court defers its review of Plaintiff's complaint #1 and motion for attorney representation #4 until Plaintiff resolves the threshold issues identified in this Order. Signed by the Honorable Franklin U. Valderrama on 2/29/2024. Mailed notice (axc). |
