January 22, 2019 Opinion or Order Filing 9 ORDER signed by the Honorable Philip G. Reinhard on 1/22/2019: The court grants plaintiff's renewed application for leave to proceed in forma pauperis #8 . The court orders the trust fund officer at plaintiff's place of incarceration to deduct $4.63 from plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee and to continue making monthly deductions in accordance with this order. The court directs the Clerk of Court to (1) send a copy of this order to the trust fund officer of the facility having custody of plaintiff; (2) file plaintiff's complaint #1 ; and (3) terminate defendants Dr. Chess and Nurse Mentor, as claims against those defendants have been dismissed without prejudice for the reasons stated below. Plaintiff's motion for service of process at government expense #5 is granted, but summonses shall not issue at this time. Plaintiff's motion for attorney representation #4 is granted. Alexander Terras, Husch Blackwell, LLP, 120 South Riverside Plaza, Suite 2200, Chicago IL 60606, alex.terras@huschblackwell.com, is recruited to represent plaintiff in accordance with counsel's trial bar obligations under N.D. Ill. Local Rules 83.11(h) and 83.37. Because of thesimilarity of the claims at issue, the court is recruiting Mr. Terras as counsel in this case and in Whitaker v. Chess, 18 C 50373. If counsel determines that plaintiff's claims may properly be combined in one case, counsel should so inform the court. By February 22, 2019, counsel shall file a brief status report indicating whether he plans to file an amended complaint or proceed with the complaint on file. If counsel believes that filing an amended complaint or proceeding with the complaint on file would be inconsistent with his Rule 11 obligations, he should so inform the court. The Clerk of Court is directed to send a copy of this order to plaintiff and to Mr. Terras. The recruited attorney falls within the class of users listed in the Electronic Public Access fee schedule adopted by the Judicial Conference of the United States, therefore, the above-named attorney shall be exempt from the payment of fees for access via PACER to the electronic case files maintained in this court for the above-captioned case and the concurrently filed case (18 C 50373) only. The recruited attorney is directed to open a separate PACER account to only be used for the above-captioned case, and fees are exempt for the above-captioned case and the previous identified cases filed in this court by this plaintiff only. The assigned attorney shall not be exempt from the payment of fees incurred in connection with other uses of the PACER system in this court. This exemption is valid immediately and for the duration of the attorney's participation in the matter. This exemption may be revoked at the discretion of the court at any time. The attorney shall contact the PACER Service Center at 1-800-676-6856 or via the link below to create the new PACER account and to make any necessary arrangements for the waiver. A copy of this order shall be sent to the PACER Service Center at http://www.pacer.psc.uscourts.gov/register.html. A copy of this order shall also be sent to the Systems Department of the Northern District of Illinois.
