Filing 18 ORDER: Plaintiff's amended complaint may proceed consistent with this order. The Court orders the Clerk of Court to (1) file the amended complaint #15 ; (2) substitute Randy Pfister as Defendant for John Doe Warden; (3) issue summonses for service of the amended complaint on Defendants Pfister, Porter, Coles, Brimmage, Menchaca, Walker, Robinson, McGruder, Brothers, Koscyk, and MacCador ; (4) terminate all other Defendants; and (4) send Plaintiff eleven blank USM-285 (Marshals service) forms, a magistrate judge consent form, filing instructions, and a copy of this order. Plaintiff must promptly complete and return a USM-285 form for service on each Defendant. Failure to return the USM-285 forms may result in dismissal of the unserved Defendant(s), as well as dismissal of this case in its entirety. Plaintiff also must promptly submit a change-of-address notification if he is transferred to another facility or released. If Plaintiff fails to keep the Court informed of his address, this action will be subject to dismissal for failure to comply with a Court order and for failure to prosecute. The Court appoints the U.S. Marshal to serve Defendants. Plaintiff's amended motion for class certification #16 is denied. Filing 14 ORDER : The Court grants Plaintiff's application to proceed in forma pauperis #3 and orders the trust fund officer at Plaintiff's place of incarceration to deduct $26.10 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee, and to continue making monthly deductions in accordance with this order. The Court directs the Clerk to send a copy of this order to the trust fund officer of the facility having custody of Plaintiff who is instructed to ensure that the records reflect all of the cases listed in this order and to make proper deductions. Summonses, however, will not issue. Plaintiff's complaint #1 is dismissed for the reasons stated below. If Plaintiff wants to proceed with this lawsuit, he must submit an amended complaint that complies with this order. Failure to submit an amended complaint by June 3, 2019, will result in summary dismissal of this lawsuit. Plaintiff also must promptly submit a change-of-address notification if he is transferred to another facility or released, or this action will be subject to dismissal for failure to comply with a Court order and for failure to prosecute. Plaintiff's motion for class certification #5 is denied, and his motion for attorney representation #4 is denied without prejudice to renewal should Plaintiff submit a viable amended complaint, after Defendants respond to the amended complaint.
