Filing 5 ORDER signed by the Honorable Philip G. Reinhard on 9/13/2021: The court denies plaintiff's application for leave to proceed in forma pauperis #4 because (1) the trust fund statement attached to the application shows that he had enough money in his account ($943.23) to prepay the $402.00 filing fee in full on the date the application was certified, and (2) he maintained an account balance between approximately $2,100 and $950 in the past six months, and the events giving rise to this lawsuit occurred before that, in February-August 2020. Consequently, he could have submitted payment of the filing fee with his complaint if he chose to do so. Plaintiff may pay by check or money order payable to Clerk, United States District Court. He should mail payment to Clerk, United States District Court, 219 South Dearborn Street, Chicago, Illinois 60604, attn: Cashier's Desk. Failure to remit the $402 fee by October 19, 2021, will result in summary dismissal of this case. The court also notes that plaintiff represented under oath in his IFP application that he had no income or assets whatsoever in the past year, which is obviously incorrect given his trust fund balances. Plaintiff is warned that his future submissions to the court must be truthful. See Ayoubi v. Dart, 640 Fed. App'x. 524, 528-29 (7th Cir. 2016) ("[N]o one needs to be warned not to lie to the judiciary"). The court defers initial review of plaintiff's complaint under 28 U.S.C. 1915A and ruling on his motion for attorney representation until after he has paid the filing fee.
