ORDER The complaint is dismissed. Although Mr. Hicks has alleged no set of facts under which his 2013 false arrest could conceivably be timely, because he is pro se the dismissal is without prejudice until February 28, 2023, at which time it will become a dismissal with prejudice in the absence of an amended complaint plausibly stating a timely claim of false arrest. The motion to proceed in forma pauperis #3 is entered and continued. The emergency motion #4 is denied in the absence of an operative complaint. See the attached Order for details.
