ORDER: The court dismisses plaintiff's complaint #1 without prejudice for failure to state a claim. Plaintiff must submit an amended complaint that states a federal claim against proper defendants. Failure to submit an amended complaint by June 28, 2023, will result in dismissal of this lawsuit for failure to state a claim. Plaintiff also must promptly update his address if it changes while this case is open. If he does not keep the court informed of his address, this lawsuit will be subject to dismissal with no further notice. The court denies plaintiff's motion for attorney representation #4 because he did not establish that he is financially eligible for court-recruited counsel. See [ 5 (Apr. 14, 2023 Order (denying Plaintiff's in forma pauperis application))]; see also Brown v. United States, 737 F. App'x 777, 781 (7th Cir. 2018) ("[T]he discretion to recruit counsel [in civil litigation] is reserved for indigent defendants[.]"). ORDER: The court denies plaintiff's application for leave to proceed in forma pauperis #3 because the trust fund statement attached to the application shows that he had enough money in his account to prepay the $402.00 filing fee in full on the date the application was certified. See [3 at pp. 2, 5]. In other words, plaintiff could have submitted payment of the filing fee along with his complaint if he chose to do so. He must pay the $402.00 filing fee. He may pay by check or money order payable to Clerk, United States District Court. He should mail payment to Clerk, United States District Court, 219 South Dearborn Street, Chicago, Illinois 60604, attn: Cashier's Desk. Failure to remit the fee by May 19, 2023, may result in summary dismissal of this case. The court defers initial review of plaintiff's complaint under 28 U.S.C. 1915A and ruling on his motion for attorney representation until after he has paid the filing fee.
