ORDER, The habeas corpus petition #1 is dismissed without prejudice. This order terminates the case. Pursuant to Glaus v. Anderson, 408 F.3d 382, 389 (7th Cir. 2005), Petitioner is advised: (1) that the Court is not making a decision on the ultimate merits of his case; (2) he may refile his claim in a new lawsuit immediately under the proper title, subject to the normal rules such as the prohibition on frivolous filings; and (3) a new suit is governed by the requirements of the Prison Litigation Reform Act. Any pending motions are denied as moot. The Clerk is instructed to: (1) terminate Respondent Kessel from the docket; (2) add Thomas E. Bergami, Warden, USP Thomson as Respondent; and (3) alter the case caption to Hoskins v. Bergami. Civil case terminated. See the attached Order for details. Signed by the Honorable Iain D.
