November 14, 2023 Opinion or Order Filing 5 ORDER: This habeas corpus case is limited to petitioner's claim that the Bureau of Prisons is wrongfully denying him credit towards his sentence earned pursuant to the First Step Act of 2018. Petitioner shall show cause by December 19, 2023 why this claim should not be dismissed for failure to exhaust his prison grievance process. Failure to respond to this show cause order by that date will result in the court considering the exhaustion issue without the benefit of his response. To the extent that petitioner's petition challenges the validity of the immigration detainer lodged against him or his immigration proceedings, such claims are dismissed without prejudice to petitioner pursuing them in a different action. October 2, 2023 Opinion or Order Filing 3 ORDER: Petitioner Jose Antonio Quintero, a federal prisoner at USP Thomson, brings this 28 U.S.C. 2241 petition to challenge the Bureau of Prisons' (BOP) refusal to apply credit toward his sentence under the First Step Act. Petitioner, however, has not addressed the $5.00 filing fee for this case. By November 6, 2023, petitioner must either: (1) pay the $5.00 filing fee by check or money order made payable to Clerk, United States District Court for the Northern District of Illinois or (2) submit a completed in forma pauperis (IFP) application with a signature of an authorized officer at his facility and a copy of his prison trust fund account statement. His failure to comply with this order will result in summary dismissal of this case without prejudice. See N.D. Ill. Local Rule 3.3(f). The Clerk is directed to send an IFP form to petitioner.
