ORDER DISMISSING CASE, COUNT ONE against DEFENDANTS HULICK, PARNELL and TOVAR is DISMISSED without prejudice, COUNT TWO fails to state a claim upon which relief may be granted, and thus is DISMISSED with prejudice, Defendants WALKER, COWAN and BENTON are DISMISSED from this action with prejudice, DENYING as moot 5 MOTION For Appointment of Officer Before Whom Written Depositions Maybe Taken, GRANTING 6 MOTION For Leave to File First Amended Complaint. Plaintiff may re-file any claim for rev ocation of his good conduct credit in a properly filed habeas corpus action, but only after he has exhausted his state court remedies.
