Denying as Moot 11 MOTION for Confirmation Screening filed by Bobby Ford. IT IS HEREBY ORDERED that COUNT TWO fails to state a claim upon which relief may be granted, and thus is DISMISSED without prejudice to the claim being filed in state court. Defendants ALTHOFF, ENGLEMANN, CARDINE, CHANEY and DANIELS are DISMISSED from this action. IT IS FURTHER ORDERED that as to COUNT ONE, the Clerk of Court shall prepare for Defendants DAVIS and BUTLER (1) Form 5 (Notice of a Lawsuit and Request to Waive Service of a Summons), and (2) Form 6 (Waiver of Service of Summons). Plain tiff is WARNED that if he attempts to file any future case that fails to include a full disclosure of his prior litigation history, such action shall be subject to immediate dismissal, and other sanctions may be imposed at the Courts discretion. Pla intiff filed another lawsuit in this Court on the same day he filed the instant action. See Ford v. Ryker, Case No. 10-cv-830-GPM (S.D. Ill. filed Oct. 21, 2010). That action was dismissed for being frivolous, and Plaintiff was assessed his third str ike (Doc. 10, Ford v. Ryker, entered March 4, 2011). Plaintiff SHALL BE REQUIRED TO PRE-PAY the full filing fee for any future lawsuit he may file while incarcerated. Plaintiff will no longer be eligible to pay a filing fee in installments using the in forma pauperis provisions of § 1915(a) and (b), unless he can establish that he is under imminent danger of serious physical injury. 28 U.S.C. § 1915(g).
