ORDER ADOPTING REPORT AND RECOMMENDATIONS 104 : For the reasons thoroughly articulated in the attached Order, the Court overrules Plaintiff's objections (Docs. 108, 147), ADOPTS in its entirety Judge Williams' Report and Recommenda tion (Doc. 104), and GRANTS IN PART/DENIES IN PART Defendants' summary judgment motions (Doc. 57, 68). The motions are granted only as to Plaintiff's deliberate indifference claim against Defendants Fenoglio, Martin, Hardy, Kimmel, and Wexford regarding medical needs resulting from the December 2010 fall. That claim is DISMISSED without prejudice for failure to exhaust administrative remedies before filing suit. The motions otherwise are denied. Defendants REED and DENSMORE are DISMISSED from this action without prejudice. IT IS FURTHER ORDERED that as to the medical negligence claims in COUNT 3, Plaintiff shall file the required affidavits pursuant to 735 ILL. COMP. STAT. §5/2-622, within 60 days of the date of this order. Should Plaintiff fail to timely file the required affidavits, COUNT 3 shall be dismissed without prejudice.
