October 28, 2016 Opinion or Order Filing 54 ORDER: Consistent with the attached memorandum and order, the Court GRANTS the consent motion to certify for settlement purposes (Doc. 53 ) and GRANTS the motion for preliminary approval (Doc. 47 ). The Court also approves, subject to the modifica tions laid out in the attached order, the proposed notice and notice plan submitted by Wyms. Notice shall be provided to the class members no later than November 28, 2016. Any class member who wishes to exclude himself from the settlement class sha ll submit a request for exclusion no later than January 30, 2017. Any class member who wishes to object to the settlement or appear at the final approval hearing must file materials no later than January 30, 2017. A final fairness hearing is SET fo r Thursday, March 23, 2017, at 9:30 AM in the East Saint Louis Courthouse to consider and finally determine whether the settlement should be approved. Papers in support of the final approval of settlement and any application by class counsel for an award of fees shall be filed with the Court on or before February 23, 2017. July 12, 2016 Opinion or Order Filing 46 ORDER: For the reasons stated in the attached memorandum and order, the motion for approval of the Fair Labor Standards Act collective action and preliminary approval of the Rule 23 class action settlement (Doc. 37 ) is DENIED without prejudice. Wy ms is DIRECTED to submit a new motion for preliminary settlement approval by Tuesday, September 6, 2016, or otherwise advise the Court as to whether the case remains settled. The consent motion to certify the class and collective action for settleme nt purposes (Doc. 42 ) is also DENIED without prejudice, with leave to resubmit alongside a new motion for preliminary approval of any settlement agreement. The deadlines and hearings put forth in the Court's settlement scheduling order (Doc. 35 ) are VACATED, and will be reset once a new motion for preliminary settlement approval is filed. June 15, 2016 Opinion or Order Filing 43 ORDER: For the reasons stated in the attached memorandum and order, the joint motion to seal (Doc. 39 ) is DENIED. The parties are DIRECTED to file an appropriate notice indicating whether they wish to proceed with settlement notwithstanding the de nial of the sealing request, or whether any party wishes to withdraw the agreement and proceed with the case. If no party requests withdrawal of the settlement agreement within seven days of the date of the entry of this order, the Court will remove the seal and proceed with the preliminary approval analysis.
