ORDER: As explained in this Order, the IDOC Defendants' Motion for Summary Judgment 280 is GRANTED in PART and DENIED in PART. Summary judgment is GRANTED as to all Defendants named in Claims 1, 2, 4, 5, and 6. This resolves all claims again st Defendants Hinton and Williams, so the Clerk is DIRECTED to terminate them, and to enter judgment in their favor at the close of the case. Claim 3 will proceed against Defendants Simmons, Eilers, Lawrence, Lashbrook, Butler, Schoenbeck, Hart, and Walker, but summary judgment will be GRANTED as to Defendants Jeffreys, Jones, Rathke, Hill, Westfall and Goldman on Claim 3. Claim 3 against Defendant Mueller is dismissed per Fed. R. Civ. P. 25(a)(1), and the Clerk is DIRECTED to terminate Muelle r. Further details are contained in this Order. Defendants' Motion to Strike 301 is DENIED, and Plaintiff's Motion for a Hearing 304 is also DENIED. The case will be set for a status conference by separate order. Signed by Judge David W.
