Filing 7 ORDER DISMISSING CASE: Plaintiff filed a Notice of Voluntary Dismissal (Doc. #6 ) pursuant to Federal Rule of Civil Procedure 41(a)(1)(A)(i), which provides that a plaintiff may dismiss an action without a court order so long as the opposing party has not served either an answer or a motion for summary judgment. Here, Defendant U.S. Marshals and FBOP have not filed answers or motions for summary judgment. Accordingly, Plaintiff's Notice of Voluntary Dismissal (Doc. #6 ) is effective immediately upon filing and does not require judicial approval. See Nelson v. Napolitano, 657 F.3d 586 (7th Cir. 2011). Filing 5 ORDER : The Court has received your Motion to Proceed Without Prepaying Fees or Costs. In the event your petition survives the preliminary review, the Court will instruct the respondent to file a response to the petition and you will be notified of your deadline to file a reply. In addition, several administrative matters warrant mention. Any communication directed to the Court should be in the form of a motion or other pleading and not a letter. Finally, you are advised that if your address changes, you must notify the Court within seven days of the change by filing a Notice of Change of Address.
