Filing 29 MOTION to Supplement Defendant's Response (Court Doc. 20) by Anthony Wills. (Schwarzlose, Rachel) |
Filing 28 ORDER denying #26 Motion to Supplement. Plaintiff seeks to amend his claim of imminent danger by supplementing the Complaint. Plaintiff alleges that even though he has been transferred to Pinckneyville Correctional Center, he is still in imminent danger due to various conditions at the facility. In the supplement, he asserts new claims against IDOC and other individuals who are not defendants in this case. The motion is denied. The Court will not consider new claims against new individuals filed only three days before the evidentiary hearing. The purpose of the hearing is to determine if Plaintiff was in imminent danger at the time of filing. See Norfleet v. Baldwin, No. 19-1337, Doc. 9 (7th Cir. April 9, 2019). See also Ciarpaglini v. Saini, 351 F. 3d 328 (7th Cir. 2003). Additionally, the Court does not accept piecemeal amendments to a complaint. An amended complaint must include all claims against all defendants. In light of Plaintiff's transfer, however, the Court will allow the parties to provide arguments at the hearing regarding the effect of the transfer on Plaintiff's claim of imminent danger, as well as his request for preliminary injunctive relief. Signed by Judge Stephen P. McGlynn on 7/22/2021. (jrj)THIS TEXT ENTRY IS AN ORDER OF THE COURT. NO FURTHER DOCUMENTATION WILL BE MAILED. |
