August 20, 2021 Opinion or Order Filing 9 ORDER granting #8 Motion Regarding Filing Fee. Plaintiff has filed a document concerned about the designation of "Civil Filing Fee Non-Prisoner" found on his filing fee receipt received from the Court. This designation does not affect the application of the Prisoner Litigation Reform Act to this case. Even though Plaintiff has paid the filing fee in full, because Plaintiff was a prisoner at the time of filing the Complaint, the Court will conduct a preliminary review of the complaint to identify legally sufficient claims and defendants and dismiss any legally insufficient claims. See 28 U.S.C. 1915A(c) (defining the term "prisoner"). If Plaintiff has viable claims, the Court will also conduct service on Plaintiff's behalf. In order to obtain court recruited counsel, Plaintiff must demonstrate that he is unable to afford counsel. 28 U.S.C. 1915(e)(1). The Court does not assume that Plaintiff is indigent because he is incarcerated. The Court will review the financial information that Plaintiff provide with his IFP Motion when considering his Motion for Recruitment of Counsel. Finally, Plaintiff's request to send him a copy of the motion is DENIED. If Plaintiff requires a copy of a filed document, he must pay the copying fee of $.50 per page to the Clerk of Court. July 1, 2021 Opinion or Order Filing 6 ORDER DENYING Plaintiff's motion to proceed in forma pauperis (Doc. #2 ). A federal court may permit an indigent party to proceed without pre-payment of fees. 28 U.S.C. Section 1915(a)(1). The Court is not satisfied from Harrison's affidavit that he is indigent. Plaintiff's trust fund account balance as of June 14, 2021 was $1,588.90 (Doc. #2 ). Accordingly, the Court DENIES the motion for leave to proceed in forma pauperis (Doc. #2 ). Plaintiff shall pay the $402.00 filing fee no later than August 2, 2021. Failure to comply with this Order will result in dismissal of this action for failure to comply with a court order under Federal Rule of Civil Procedure 41(b). Fed. R. Civ. P. 41(b). June 30, 2021 Opinion or Order Filing 5 NOTICE AND ORDER: The Court has received your complaint and your motion to proceed without prepayment of the filing fee. Your case number is 21-762-SPM. The following is some information you should know regarding the initial stages of your lawsuit.
