January 3, 2022 Opinion or Order Filing 6 ORDER. This matter is before the Court for case management. Plaintiff has failed to pay the filing fee and has not returned the Notice Regarding Magistrate Judge Jurisdiction as required by Administrative Order No. 257. A review of the document filed as the Complaint (Doc. 1) shows that Plaintiff intended to file a Petition for Writ of Habeas Corpus Under 28 U.S.C. 2241 as opposed to a civil claim based on Bivens v. Six Unknown Named Agents of Federal Bureau of Narcotics, 403 U.S. 388 (1971) as docketed. Accordingly, the Clerk of Court is DIRECTED to ADMINISTRATIVELY CLOSE this case without the assessment of a filing fee and refile Document 1 as a Petition for Writ of Habeas Corpus Under 28 U.S.C. 2241 in a new case. Signed by Judge Staci M. Yandle on 1/3/2022. (ksp)THIS TEXT ENTRY IS AN ORDER OF THE COURT. NO FURTHER DOCUMENTATION WILL BE MAILED.

The Clerk notes that due to the COVID-19 public health crisis, deadlines that were pending on or before April 1, 2020 were extended in accord with Administrative Order No. 261 and/or Amended Administrative Order No. 261. This automated notice does not take into account any such extensions. November 29, 2021 Opinion or Order Filing 4 ORDER. In her Complaint, Plaintiff seeks a Temporary Restraining Order ("TRO") and/or Preliminary Injunction pursuant to Federal Rule of Civil Procedure 65 for immediate release from the Federal Bureau of Prisons due to conditions of confinement that pose a serious risk to her health. Release from confinement is not available for prisoners filing a civil claim based on Bivens v. Six Unknown Named Agents of Federal Bureau of Narcotics, 403 U.S. 388 (1971), the federal equivalent of 42 U.S.C. 1983. See Glaus v. Anderson, 408 F.3d 382 (7th Cir. 2005).
