ORDER: Despite the dismissal, Plaintiff remains obligated to pay the full filing fee. Plaintiff was not granted leave to proceed in forma pauperis in the original case (26-cv-0670-JPG) or in this case. Consequently, he must pay a $405.00 filing fee. The agency having custody of the plaintiff is directed to remit the $405.00 filing fee from his prison trust fund account if such funds are available. If he does not have $405.00 in his account, the agency must send an initial payment of 20% of the current balance or the average balance during the past six months, whichever amount is higher. Thereafter, the agency shall begin forwarding monthly payments of 20% of the preceding months income credited to Plaintiff's trust fund account (including all deposits to the inmate account from any source) until the statutory fee of $405.00 is paid in its entirety. The agency having custody of Plaintiff shall forward payments from Plaintiff's account to the Clerk of Court each time the Plaintiff's account exceeds $10.00 until the $405.00 filing fee is paid. Payments shall be mailed to: Clerk of the Court, United States District Court for the Southern District of Illinois. The Clerk is DIRECTED to mail a copy of this Order to the Trust Fund Officer at FCI-Marion upon entry of this Order. Furthermore, to enable the Bureau of Prisons to remit the directed filing fee payments to the Clerk of Court, Plaintiff shall complete, sign, and return one Consent Form -- In Forma Pauperis Proceedings to the Clerk of this Court in the envelope provided, by July 16, 2026. The Clerk is DIRECTED to provide two copies of the appropriate form to Plaintiff with a copy of this Order, along with a pre-addressed return envelope. Failure to provide the Clerk of Court with this authorization shall be grounds for dismissal of this case. Fed. R. Civ. P. 41(b); see generally Ladien v. Astrachan, 128 F.3d 1051 (7th Cir. 1997); Johnson v. Kamminga, 34 F.3d 466 (7th Cir. 1994). Upon receipt of Plaintiff's signed consent form, the Clerk shall mail a copy of this Memorandum and Order and an executed copy of the consent form to the Warden at FCI-Marion, as well as e-mail a copy of this Memorandum and Order and an executed copy of the consent form to the Trust Fund Management Staff at FCI-Marion. ORDER DISMISSING CASE: Plaintiff was ordered to affirmatively notify the Court whether he wanted to proceed with this case or voluntarily dismiss it (Doc. 4). Plaintiff was also warned that his failure to respond would result in this case being dismissed without prejudice (Doc. 4), and he would still be obligated to pay the full filing fee. The deadline for responding expired on June 17, 2026, and the Court has not heard from Plaintiff. Mail sent to Plaintiff has been returned undelivered, and Plaintiff has not provided the Court with his updated address in violation of his ongoing obligation to do so (see Docs. 5 and 7). He also failed to respond to the Order to Show Cause why this action should not be dismissed (see Doc. 6). Accordingly, this case is DISMISSED without prejudice pursuant to Federal Rule of Civil Procedure 41(b) for failure to follow Orders of the Court and failure to prosecute. The Court will separately enter an Order regarding the filing fee obligation for this matter, and the Clerk of Court is DIRECTED to enter judgment accordingly thereafter. Signed by Judge J. ORDER TO SHOW CAUSE: Plaintiff's mail was recently returned undelivered to the Court with a note indicating that it is "not deliverable as addressed." (See Docs. 4, 5). The inmate's name (Ivan Moore), number (48468-044), or current address (Marion FCI - Federal Correctional Institution, P.O. BOX 1000, Marion, IL 62959) may be incorrect. Plaintiff was previously advised of his continuing obligation to keep the Clerk of Court and each opposing party informed of any change in his address because the Court will not independently investigate his whereabouts. See Case No. 26-00670-JPG (Doc. 13). Plaintiff was ORDERED to NOTIFY the Court of any change in his address in writing no later than 14 days after a transfer or other address change occurs. He was also WARNED that failure to comply with this Order will cause a delay in the transmission of court documents and may result in dismissal for want of prosecution. FED. R. CIV. P. 41(b). Plaintiff is ORDERED to Show Cause why this case should not be dismissed for failure to comply with the Court's Order(s) and/or for failure to prosecute; his response is due on or before JUNE 24, 2026. ORDER: On 5/21/2026, this case was severed from Eric Hall, et al. v. Bradley, et al., SDIL Case No. 26-cv-0670-JPG. Plaintiff should be aware of the consequences of proceeding with this action. First, the Court will screen the action pursuant to 28 U.S.C. 1915A, and Plaintiff will incur a strike within the meaning of section 1915(g) if the Court determines that the action is frivolous or malicious, fails to state a claim on which relief may be granted, or seeks monetary relief against a defendant who is immune from such relief. Second, Plaintiff will be required to pay an additional $405.00 filing fee in this case ($350.00 if he is granted leave to proceed in forma pauperis). Of course, Plaintiff can also opt not to proceed with this action by voluntarily dismissing it, thereby avoiding the risk of a strike and the financial burden of an additional filing fee. Plaintiff should carefully consider these points, along with the merits and relative importance of this lawsuit, in deciding whether to proceed with it. Plaintiff shall have until June 17, 2026, to advise the Court in writing whether he wishes to proceed with this lawsuit. If he chooses to go forward, he should also send the $405.00 filing fee, or a motion and affidavit for leave to proceed in forma pauperis (along with the required certification and Trust Fund statement). After the fee status is resolved, the Court will screen the complaint. On the other hand, if Plaintiff opts to voluntarily dismiss the case by the deadline, he will not have to pay a filing fee, the Court will not screen the complaint, and the case will be dismissed without prejudice. Plaintiff is WARNED that if he fails to respond to this Order by the deadline, he will be obligated to pay the full filing fee, and this action will be dismissed for want of prosecution and/or for failure to comply with a court order.
