Filing 117 ENTRY ON MOTIONS FOR SUMMARY JUDGMENT. For the reasons discussed herein, Captain's motion for summary judgment is granted in part and denied in part (dkt. 99). It is granted as to Count I of the complaint and the bona fide error defense and de nied as to any claim based on the statement in the ARS letter that interest was accruing to the account. ARS's motion for summary judgment is denied (dkt. 101). The court will confer with counsel to schedule a trial on damages or other means to conclude this matter.
