Filing 65 ORDER GRANTING 42 Motion for Summary Judgment. Judgment as a matter of law is appropriate when a party "fails to make a showing sufficient to establish the existence of an element essential to that party's case, and on which that party wi ll bear the burden of proof at trial." Celotex Corp. v. Catrett, 477 U.S. 317, 322 (1986). That is the case here. Showalter has not identified a genuine issue of material fact as to his claims in this case, and the defendants are entitled to jud gment as a matter of law. Accordingly, the motion for summary judgment filed by Town of Thorntown Marshal Jeff Woodard and Town of Thorntown Deputy Marshal Duane Lewellen (dkt 42) must be GRANTED.
