April 17, 2012 Opinion or Order Filing 128 ENTRY ON CROSS-MOTIONS FOR SUMMARY JUDGMENT - Greystone's Motion for Summary Judgment (Dkt. 98 ) is GRANTED with respect to Valley Forge's claims for theft, conversion, and violating the Indiana Securities Act, and DENIED with respect to Valley Forge's breach of contract claim and its own breach of contract counterclaim. December 30, 2011 Opinion or Order Filing 103 ENTRY re 81 DEFENDANT'S OBJECTION TO THE MAGISTRATE JUDGE'S ORDER - Greystone's objections should be overruled because the Magistrate Judge's decision was not clearly erroneous or contrary to law. And, as a practical matter, the Court finds that this issue is best settled through the summary judgment briefing, which has already begun in this case. A contrary decision needlessly risks "jumping the gun." Given the deferential standard of review and the fact that this issue is already being hashed out in dispositive motion briefing [Dkt. 100 and 102 ], the Court OVERRULES Greystone's objections to the Magistrate Judge's order [Dkt. 81 ]. Signed by Judge Tanya Walton Pratt on 12/30/2011. (JD)
January 6, 2010 Opinion or Order Filing 50 ENTRY ON DEFENDANT'S MOTION FOR JUDGMENT ON THE PLEADINGS: For the foregoing reasons, the Defendants Motion for Judgment on the Pleadings 20 is GRANTED as to Count IV; however, the Motion is DENIED as to Counts I, II, and III **SEE ENTRY**. Signed by Judge William T. Lawrence on 1/6/2010. (DWH)
