Judgment consistent with this Entry shall now issue. The dismissal of the Fourth Amendment excessive force a nd failure to protect claims shall be without prejudice, while the dismissal of the Eighth and Fourteenth Amendment deliberate indifference to a serious medical need claim shall be with prejudice.
