ORDER granting 53 Motion for Summary Judgment. For the reasons discussed herein, defendants' motion for summary judgment is granted. Judgment consistent with this Entry shall now issue. The dismissal of the Fourth Amendment excessive force a nd failure to protect claims shall be without prejudice, while the dismissal of the Eighth and Fourteenth Amendment deliberate indifference to a serious medical need claim shall be with prejudice.
