December 18, 2012 Opinion or Order Filing 168 ORDER - The Court GRANTS IN PART AND DENIES IN PART Ms. Walton's Motion for Partial Summary Judgment, [dkt. 100 ]. The Court GRANTS IN PART AND DENIES IN PART Chase's Cross-Motion for Summary Judgment on Counts V and VI, [dkt. 120 ]. M s. Walton's Motion for Leave to File Sur-Reply Brief in Opposition to Defendant Chase Home Finance, LLC's Cross-Motion for Partial Summary Judgment Under Local Rule 56.1(d), [dkt. 162 ], is DENIED AS MOOT. As to Ms. Walton's claim for an "accounting" under RESPA (Count VIII), the Court ORDERS Ms. Walton to SHOW CAUSE by December 28, 2012 why the Court should not grant summary judgment in favor of Chase on that claim pursuant to Fed. R. Civ. P. 56(f) because it does not appear that RESPA recognizes a claim for an accounting. The Court notes several upcoming deadlines set forth in the Case Management Plan and subsequent Orders, and expects the parties to strictly comply with all of those deadlines. Any failur e to do so may result in the imposition of sanctions. The Court further requests that the magistrate judge confer with the parties in the very near future to ascertain whether an agreed resolution is possible. During the hearing, the Court also addressed Defendant's Motion for Protective Order. [Dkt. 139.] Plaintiff's coun sel represented that Plaintiff would not object to that motion.
