Filing 30 ORDER - denying 29 Motion for Relief of Final Judgment *** SEE ENTRY ***. Signed by Judge Sarah Evans Barker on 9/28/2012. Copy Mailed. (CKM) |
Filing 14 ENTRY - This civil rights action was dismissed May 11, 2011, based on the plaintiff's failure to obey an order of the court. The matter presently before the court is the plaintiff's motion for relief from judgment filed on December 2, 2 011.In order for a Rule 60(b) movant to obtain the relief requested, he must show that he had both grounds for relief, Fed. R. Civ. P. 60 (b)(1)-(5), and a meritorious claim or defense. Breuer Electric Mfg. Co. v. Toronado Systems of America, Inc., 687 F.2d 182, 185 (7th Cir. 1982). His motion for relief from judgment 11 does not show either of these circumstances. That motion is therefore DENIED. *** SEE ENTRY ***. Signed by Judge Sarah Evans Barker on 1/24/2012. cm(CKM) |
