Filing 40 ORDER denying 32 Plaintiff's Motion for Attorney Fees - Even though the Court ordered a remand, the Court finds that the Commissioner was substantially justified in its denial of Mr. Turpen's benefits and in its defense of that denial in this matter. Filing 30 ENTRY Reviewing The Commissioner's Decision - Because an issue of fact remains as to whether Mr. Turpen timely submitted his military records and, if so, the impact of those records on his disability application and because the ALJ failed to build a logical bridge as to how Mr. Turpen's work history can be viewed as "successful," the Court VACATES the denial of benefits and REMANDS this matter back to the Commissioner for further proceedings.
