Accordingly, their motion for summary judg ment 44 must be granted. The motion for entry of judgment against plaintiff for his failure to respond 66 is denied as unnecessary. Summary judgment is also being granted in favor of defendant Michael Fogarty (Dkt. # 67 ). All claims have now been resolved. Judgment dismissing the action with prejudice shall now issue. The first such installment shall be paid no later than November 21, 2011, and each installment thereafter shall be paid on or before the 20th day of each subsequent month. The full filing fee is $350.00. As submitted, certain claims must be dismissed for fail ure to state a claim upon which relief can be granted. Any claim for damages asserted directly under the Indiana Constitution is dismissed because there is no private cause of action for damages under the Indiana Constitution. The clerk is designate d, pursuant to Fed. R. Civ. P. 4(c)(3), to issue and serve process on the defendants in the manner specified by Fed. R. Civ. P. 4(d)(1).
