ORDER - On Defendants Motions for Summary Judgment; This cause is before the Court on three defense motions: (1) Defendant Tri-State Thermo King's Motion for Summary Judgment [Docket No. 97], filed on June 19, 2013; (2) Defendant Thermo Ki ng Corporation's Motion for Summary Judgment [Docket No. 100], filed on June 24, 2013; and (3) Defendant Tri-State Thermo King's Motion to Strike Hearsay [Docket No. 112], filed on August 28, 2013. Because the arguments raised in the briefing of both summary judgment motions are nearly identical, we resolve these motions, and the related Motion to Strike, in a combined fashion.
