September 12, 2012 Opinion or Order Filing 8 ENTRY AND ORDER DISMISSING ACTION - The amended complaint filed by Stacy Perkins has been considered. Perkins' amended complaint fails to cure the deficiencies noted in the Entry of July 17, 2012. Perkins' amended complaint could be un derstood as asserting claims under Indiana state law. Because all federal claims have been dismissed at this early point, the court declines to exercise its supplemental jurisdiction over any other asserted state law claim including that of libel and false arrest. The action is not dismissed at this point. Rather, Perkins will be permitted to file an amended complaint with respect to one of the two defendants. If an amended complaint is filed as permitted in this Entry, the court will determine its legal sufficiency and enter whatever or der which is warranted. If no amended complaint is filed as directed in this Entry, the action will be dismissed for failure to state a claim upon which relief can be granted.
