Filing 24 ENTRY - The Complaint is dismissed. The dismissal of the complaint will not in this instance result in the dismissal of the action. Instead, the plaintiff shall have through February 19, 2013, in which to file an amended complaint. If no amended c omplaint is filed as permitted in Part II of this Entry, the action will be dismissed consistent with the dismissal of the complaint in Part I. All other proceedings are stayed. Given the dismissal of the complaint, and the time for filing an ame nded complaint all pending motions are denied without prejudice as premature, including plaintiff's motion for summary judgment [Dkt. 14 ], motion for federal investigation [Dkt. 15 ], motion to appoint counsel [Dkt. 16 ] and motion to compel [Dkt. 19 ].
