It fails to state a claim having facial plausibility and thus fails to state a claim upon which relief can be granted. The c omplaint is therefore dismissed. Final judgment shall not issue at this time. Instead, Coleman shall have through September 27, 2012, in which to file an amended complaint. If no amended complaint is filed as permitted in Part II of this Entry, the action will be dismissed consistent with the dismissal of the complaint in Part I. (SEE ENTRY).
