ENTRY granting Defendant Herb Troyer's 39 Motion for Summary Judgment; granting Defendants D. Alsip and Jennifer Rhinehart's 36 Motion for Summary Judgment. No partial final judgment shall issue as to the c laims resolved in this Entry. Gray shall have through March 24, 2014, in which to show cause why his claims against defendant Franklin should not be dismissed pursuant to Rule 56(f) of the Federal Rules of Civil Procedure for the same reasons the claims against defendants Alsip, Rinehart, and Troyer have been dismissed. Failure to show cause will result in the dismissal of the action without prejudice (see Entry for additional information). Copy to Plaintiff via US Mail. ENTRY - The clerk shall include a copy of Gray's motion to clarify claims [dkt. 11 ] with the plaintiff's copy of this Entry. That motion [dkt. 11 ] is GRANTED TO THE EXTENT that it is treated as a response to the Court's direc tions that he supplement his complaint. Certain of Gray's claims shall proceed, while others will be dismissed. The plaintiff's request for class certification is DENIED. The following claim shall proceed: Gray's claim that defendan ts Alsip, Franklin, Rhinehart, and Troyer acted with deliberate indifference to his request for help, causing him to be beaten by other inmates. All other claims are dismissed. The clerk is designated to issue and serve process on defendants D. Alsip, Mr. Franklin, Jennifer Rhinehart, and Herb Troyer. ***SEE ENTRY***.
