The State's motion for summary judgment (Dkt. No. 59) is DENIED. Within 21 days of the date of this Entry, the parties shall file either a joint notice, or if they cannot agree, separate notic es setting forth what issues, if any, remain to be resolved before final judgment is issued consistent with this Entry and what the final judgment should include, given Mr. Elliott's prayer for relief (see Entry for additional information).
