Filing 346 ORDER - The Court GRANTS IN PART Travelers' 282 Motion to Exclude Opinion Testimony of Richard Potosnak to the extent that Mr. Potosnak cannot testify regarding the KCE Document, the KCE Model, any opinions regarding the correctness of the facts underlying Travelers' experts' opinions, or any opinions or conclusions relating to any "apportionment" of costs between those related to reasonably restoring the damaged property to its pre-loss condition and those not re lated. Additionally, the Court GRANTS IN PART Travelers' 284 Motion to Exclude the Opinion Testimony of Mark Flandermeyer to the extent that Mr. Flandermeyer is not permitted to provide opinion testimony regarding the correctness of the fact s underlying Travelers' experts' opinions, or any opinions regarding apportionment of costs incurred by IAA between those related to reasonably restoring the damaged property to its condition before the Shoring Tower Incident, and those n ot related. The Court DENIES AS MOOT Travelers' Motion to Exclude the Opinion Testimony of Mark Flandermeyer as to the additional categories of testimony discussed therein, because IAA has stated that it will not present such testimony. The Court DENIES IAA's Motion for Partial Summary Judgment in its entirety, [Filing No. 222], and GRANTS Travelers' Cross Motion for Summary Judgment, [Filing No. 238], to the extent that it finds that the disputed Policy provisions are unambiguous, and: (See Order.) The Court DENIES IN PART Travelers' Cross Motion for Summary Judgment, [Filing No. 238], however, to the extent that the Court cannot conclude as a matter of law that Travelers has paid all costs covered by t he Policy's General Coverage Provision. No partial final judgment shall issue at this time. It is the Court's hope that this ruling significantly limits the issues that remain in this litigation, and the Court requests that the Magistrat e Judge confer with the parties to address the possibility of resolving the remaining issue - i.e., whether any outstanding costs fall within the Policy's General Coverage Provision, in light of the Court's finding regarding the parameters of that provision - prior to the June 6, 2016 trial scheduled in this matter. Filing 200 ORDER. The Court SUSTAINS Travelers' Objection to Magistrate's Order. [Filing No. 115.] Travelers is granted an additional four hours to depose Mr. Potosnak pursuant to Rule 30(d)(1). The undersigned also notes that this case involves mo re discovery disputes than the undersigned's other non-prisoner civil cases combined. Counsel are reminded that discovery is intended to be a self-managed process, see Fed. R. Civ. Pro. 29(b), and the size of the amount in controversy does no t alter that principle. The record before the Court reveals a lack of cooperation that appears to have obstructed, rather than elucidated, the development of the factual record in this case. SEE ORDER.
