Filing 120 ENTRY ON DEFENDANTS' MOTION FOR SUMMARY JUDGMENT - 92 Motion for Summary Judgment is GRANTED in part AND DENIED in part. Summary judgment is DENIED as to all Defendants on Pender's due process claim. Defendants James Basinger, Ed Buss, Ja net O'Neal, Leslie Johnson, Michael Wilkerson and Bruce Lemmon are GRANTED summary judgment on Pender's Eighth Amendment claim. Summary judgment is DENIED as to Defendants Stephanie Peckham, Shirley Washington, Vanessa Tolbert, Steve McCaul ey, Stanley Knight, and Michael Osburn on Pender's Eighth Amendment claim. Accordingly, the due process claims against all defendants, as well as the Eighth Amendment claims against Washington, Tolbert, McCauley, Knight, and Osburn will proceed. Further proceedings, including a settlement conference and a trial will be scheduled in a separate order. If Pender requests the assistance of counsel with these further proceedings, she must file a motion on the Court's form. The Clerk shall include a form with Pender's copy of this Entry.
