Filing 69 ENTRY ON MOTIONS TO DISMISS: For the reasons set forth above, the motion to dismiss filed by Defendant Merchant Capital, LLC (Dkt. No. 15), and the motion to dismiss filed by the remaining Defendants (Dkt. No. 44) are both GRANTED. The c laims against Defendant Merchant Capital, LLC, and the defamation claims against the remaining Defendants are DISMISSED WITHOUT PREJUDICE. If the Plaintiff believes it can, in good faith, remedy the deficiencies discussed herein by fili ng a second amended complaint, it may do so within 14 days of the date of this Entry. The failure to timely file a second amended complaint will result in the dismissal of the claims in question being with prejudice ***SEE ENTRY FOR ADDITIONAL INFORMATION***.
