March 13, 2017 Opinion or Order Filing 53 ENTRY ON DEFENDANTS' MOTION TO DISMISS AND ORDER TO REMAND - For the reasons stated above, the City of Carmel Defendants' Motion to Dismiss (Filing No. 7 ) is GRANTED in part and DENIED in part. The Motion is granted to the extent th at all federal claims are dismissed. This ruling applies to all parties. The Motion is denied to the extent that the state law claims shall be REMANDED to the Hamilton Superior Court, Case No. 29D02-1601-CT-0043, for consideration. Final judgment dismissing the federal claims and an Order of Remand consistent with this Entry shall issue in separate orders. (See Entry.) Copy to Plaintiff via U.S. Mail.
