Filing 43 ORDER ON DEFENDANT'S MOTION TO DISMISS AND TO STRIKE IRRELEVANT ALLEGATIONS OF PLAINTIFF'S COMPLAINT - For the foregoing reasons, the Defendant's Motion for Partial Dismissal and to Strike Irrelevant Allegations of Plaintiff's Complaint (Filing No. 27 ) is GRANTED in part and DENIED in part. Count II is dismissed with prejudice. Mr. Deppe's injunctive relief claims are dismissed without prejudice. The Defendant's motion to strike is denied. Mr. Deppe is granted leave of twenty one days (21) from the date of this Order within which to file an amended complaint regarding his injunctive relief claims. (See Order.)
