For the reasons stated above, the Court DENIES Intervenor Plaintiff Unitrin Preferred Insurance Company's Motion for Partial Summary Judgment (Filing No. 128 ), and GRANTS Intervenor Defendant Pr ivilege Underwriters, Inc.'s Motion for Partial Summary Judgment (Filing No. 132 ). PURE does not owe a duty to defend Defendant Jane Smith in this action, and it does not owe reimbursement to Unitrin for the defense costs that Unitrin incurred while defending Jane Smith in this action. Filing 122 ORDER GRANTING DEFENDANTS' PARTIAL MOTION TO DISMISS - The Court determines that dismissal of the Title IX claim against the Individual Defendants is appropriate. There are no set of facts that would allow the Plaintiff to pursue this claim a gainst the Individual 3 Defendants, and thus, the Court concludes that, pursuant to Rule 12(b)(6), the Partial Motion to Dismiss for failure to state a claim upon which relief can be granted (Filing No. 64 ) must be and hereby is GRANTED. Count I V of the Amended Complaint is dismissed with prejudice as to Defendants James Danko, Levester Johnson, Stacie Colson Patterson, Anne Flaherty, Sally Click, Erin McCluney, Robert Padgett, and Martha Dwizlik.
