September 28, 2018	Filing 80 ENTRY ON DEFENDANTS' MOTIONS FOR SUMMARY JUDGMENT TO EXCLUDE EXPERT - Mancini and her son K.C., suffered horrendous injuries and a grievous lack of discretion by the officers; however, a grievous lack of discretion does not suffice to state a constitutional cause of action under binding Seventh Circuit precedent. For the foregoing reasons, the Court GRANTS the City's Motion for Summary Judgment ( Filing No. 65 ) and the City's Motion to Exclude Expert Testimony of Ernest B urwell (Filing No. 75 ) is DENIED as moot. Moreover the claims against defendants' Does 1-50 and Roe Corporations 1-10 are dismissed without prejudice. Final judgment will be issued in a separate document. (See ENTRY.) September 26, 2017	Filing 52 ORDER ADOPTING REPORT AND RECOMMENDATIONS - Ms. Mancini's Objection to Magistrate's Report and Recommendation (Filing No. 43 ) regarding the City's Motion to Dismiss is SUSTAINED in part and OVERRULED in part. The Motion to Dismi ss (Filing No. 12 ) is GRANTED in part and DENIED in part. Defendants IMPD, Officer Defendants in their official capacities, Rick Hite, and all named police officers in their individual and official capacities are DISMISSED with prejudice. Ms. Ma ncini's Fourteenth Amendment claim against all Defendants is DISMISSED with prejudice. The remaining claims for trial in this case are the Fourth Amendment claim, pursuant to 42 U.S.C. § 1983 under Count I, and the Monell claim under Count II. See Entry for details.
