There is no rebuttal evidence. Outside the presence of the jury, counter claim defendant moves for entry of judgment as a matter of law pursuant to Fed. R. Civ. Proc. 50. The Court takes the motion under advisement. Outside the presence of the jury, the Court presents the parties with a draft of final instructions and verdict form; argument is held on objections to the proposed instructions and verdict form. The Court rules on the objections. Final arguments are made. Copies of the final instructions and verdict form are distributed to the jurors; the Court reads the final instructions and verdict form to the jury. The Court gives closing instructions. The bailiff, Cara Chittenden, who is to take charge of the jury, is duly sworn. The jury retires to conduct its deliberations. The bailiff notifies the Court that the jury has provided a question (see Exhibit No. 1) that the jury would like to have answered. The parties are notified of the fact that the jury has submitted a question; the Court provided a copy of the question to the parties. There was a discussion of what answer should be given to the jury; the parties agreed on a response. The Court provided the jurors with the agreed upon response in writing. The jury returned to open court and stated it had reached a verdict. The verdict found for the counter claimant. The verdict was read aloud and was accepted by the Court. The jury was discharged. No. #75 and the motion for entry of a Rule 54(b) judgment filed by Counterclaim Defendant Karma International, LLC ("Karma") (Dkt. No. #88 . The Court, being duly advised, GRANTS IMS's motions and DENIES Karma's motion forthe reasons. In addition, Karma does not only ask that it be permitted to appealnow, but also that the trial of IMS's case be postponed pending that appeal. However, the trial is scheduled for a few weeks from now; thus, the delay of the resolution of IMS's claim would be significant. That delay is certain, while, on the other hand, it is possible, but not certain, that a second trial will be required following Karma's appeal.
