The Court reduces Franciscan's modified request for costs in the amount of $9,023.15 by $3,630.44, and awards Franciscan $5,392.71 in reasonable and necessary costs incurred in this litigation. June 4, 2018 Opinion or Order Filing 57 ORDER - granting 35 Defendant's Motion for Summary Judgment. This matter is before the Court on a Motion for Summary Judgment filed pursuant to Federal Rule of Civil Procedure 56 by Defendant Franciscan Alliance, Inc. ("Franciscan&qu ot;) (Filing No. 35 ). Franciscan is a network of hospitals and health care providers, serving patients in Indiana and Illinois. Plaintiff Mary Rose ("Rose") is an employee of Franciscan, who was denied a new position at one of Francisc an's hospitals in central Indiana. After Rose was not offered the new position, and she initiated this lawsuit asserting a claim for disability discrimination under the Americans with Disabilities Act of 1990, 42 U.S.C. § 12101 ("AD A"). Franciscan filed a Motion for Summary Judgment, asserting that Rose was not a qualified individual, and there is no evidence of discrimination on the basis of disability. Defendant Franciscan Alliance, Inc.'s Motion for Summary Judgment (Filing No. 35 ) is GRANTED, and Plaintiff Mary Rose's ADA claim is dismissed. Final judgment will issue under separate order.
