Winding Ridge's Cros s-Motion is GRANTED as to the Policy's coverage of cosmetic shingle damage and as to State Farm's two-year defense. In all other respects, the Cross- Motion for Partial Summary Judgment is DENIED. The Court GRANTS State Farm's Motion for Summary Judgment (Filing No. 83 ) and determines that all claims should be DISMISSED. State Farm's Motion to Preclude or Limit Expert Testimony ( Filing No. 128 ) is DENIED as moot. The Court will issue final judgment in a separate order.
