Date Filed Document Text
March 9, 2020 Opinion or Order Filing 164 ENTRY DENYING POST-JUDGMENT MOTION - There is no legal basis on which to focus entirely on the two-month period of time between Dr. Persons requests for the specialist and thereby find deliberate indifference. Dr. Person responded with various tr eatments in an effort to alleviate the plaintiffs pain. In addition, as explained above, the specialist did not disagree that physical therapy was the appropriate treatment, nor did an MRI reveal any other path toward treatment that had not been t aken. The plaintiff has not shown any error in granting summary judgment in favor of Dr. Person. For the above reasons, the plaintiffs Rule 59(e) motion to alter judgment, dkt. 159 , is denied. (Copy to Plaintiff via U.S. mail). Signed by Judge James R. Sweeney II on 3/9/2020. (JDC)
September 27, 2019 Opinion or Order Filing 157 ENTRY DISCUSSING MOTION FOR SUMMARY JUDGMENT OF DEFENDANTS PERSON, BERGESON, EDWARDS, COLLINS, KING, CORIZON, AND WEXFORD - For the reasons discussed above, the moving defendants are entitled to judgment as a matter of law. Accordingly, the motion for summary judgment filed by defendants Person, Bergeson, Edwards, Collins, King, Corizon, and Wexford, dkt. 85 , is granted. Judgment consistent with this Entry and with the Entry granting Dana Miller's motion for summary judgment, shall now issue. ***SEE ORDER FOR ADDITIONAL DETAILS*** (Copy to Plaintiff via U.S. mail) Signed by Judge James R. Sweeney II on 9/27/2019. (JDC)
