April 30, 2018 Opinion or Order Filing 28 ORDER - Plaintiff Brian Kane brings this action pursuant to Title VII of the Civil Rights Act of 1964, alleging that Defendant Finance of America Reverse, LLC ("Finance of America") discriminated against him because of his race following remarks he made on social media criticizing the Black Lives Matter movement. Mr. Kane further alleges that Finance of America retaliated against him for complaining about this discrimination, and that he was subjected to a hostile work environmen t. Presently pending and ripe for the Court's consideration are: (1) Finance of America's Motion for Judgment on the Pleadings, [Filing No. 20 ]; and (2) Mr. Kane's Motion for Nunc Pro Tunc Order Accepting His Opposition Motion as Timely, [Filing No. 25 ]. For the foregoing reasons, the Court GRANTS Mr. Kane's Motion for Nunc Pro Tunc Order Accepting His Opposition Motion as Timely, 25 . The Court also GRANTS IN PART Finance of America's Motion for Judgment on t he Pleadings as it relates to Mr. Kane's hostile work environment claim, and DENIES IN PART the motion as it relates to Mr. Kane's retaliation and race discrimination claims. 20 . Mr. Kane's hostile work environment claim is DISMIS SED WITH PREJUDICE, but no partial final judgment shall issue at this time. Mr. Kane's retaliation and race discrimination claims remain pending, and the Court requests that the Magistrate Judge confer with the parties regarding a possible resolution of this matter short of trial.
