Filing 20 Order Denying Petition for a Writ of Habeas Corpus - Petitioner Sam Milligan is an Indiana prisoner who filed the instant petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2254 challenging his state court convictions for murder and attempted murder. In the end, the Court concludes that his petition is time-barred and that a certificate of appealability should not issue. Rule 11(a) of the Rules Governing Section 2254 Proceedings in the United States District Courts requires the district court to "issue or deny a certificate of appealability when it enters a final order adverse to the applicant." Reasonable jurists could not disagree that Mr. Mulligan's habeas petition is barred by the statute of limitations. Therefore, a certificate of appealability is denied.
