Filing 60 ORDER - This case arises following the suicide of Joshua Bellamy while he was an inmate in the Marion County Jail. Plaintiff Kelley Vale-Gugliuzzi, as representative of Mr. Bellamy's estate, raises multiple claims against a variety of defenda nts, including Correct Care Solutions LLC ("CCS"). Presently pending before the Court is CCS's Motion for Judgment on the Pleadings. For the reasons described below, the Court denies CCS's Motion. In a case alleging municipal l iability under 42 U.S.C. § 1983, this Court applies the pleading requirements of Rule 8(a) of the Federal Rules of Civil Procedure--not a more stringent standard. For the reasons described above, the Court DENIES defendant CCS's Motion for Judgment on the Pleadings 49 . (SEE ORDER). Signed by Judge Jane Magnus-Stinson on 7/13/2018. (APD) |
