Filing 78 ORDER DENYING MOTION FOR SUMMARY JUDGMENT - Plaintiff Timothy A. Endre, an inmate at Greenville Federal Correctional Institution in Greenville, Illinois, alleges that Bureau of Prison (BOP) employees failed to protect him from sexual assault by an other inmate while he was incarcerated at the Federal Correctional Complex in Terre Haute, Indiana (FCC Terre Haute). Mr. Endre brings this suit under the Federal Tort Claims Act (FTCA) against the United States of America for money damages. The United States seeks resolution of this action through summary judgment.
